AMD Xcelerate Program – Official Rules (Terms & Conditions)

These Official Rules (these “Official Rules”) govern your participation in AMD Xcelerate program. If you do not agree to any provision of these Official Rules, do not register for or participate in Xcelerate program. By registering or participating in Xcelerate program, you agree to be bound by these Official Rules:

    Program Eligibility

  1. The program is open to partners who are invited by AMD APAC Team. To participate in AMD Xcelerate program, an Eligible Participant must have an approved AMD reseller and have received an invitation email from the Program Manager. An Eligible Participant must register to participate by submitting all required registration information through the Xcelerate program website and receive a confirmation of registration via email or regular mail from either AMD or its program administrator (each a “Registered Participant”). AMD reserves the right to reject any registration in its sole discretion and may terminate, suspend or cancel any Registered Participant’s right to participate in Xcelerate program at any time. Registered Participants are permitted to use the Xcelerate program website to participate in AMD-approved promotions through the Xcelerate program. Partner representatives may not participate in the Program if doing so would violate any of their employer's policies. By participating in this Program, you confirm that you have obtained your employers' prior consent and approval to do so and that it does not violate any of your employer's policies. You must be enrolled in the AMD Xcelerate Portal, have a valid AMD Partner account in good standing, and a signed AMD Partner Agreement to earn and receive rewards in the Program.
  2. Regional Participation: Only Indonesia, Japan, Malaysia, Philippines, Singapore, Vietnam, Thailand, Australia, New Zealand residents who are 18 years of age or older at the time of award and who are employed on a full-time or part-time basis by a AMD authorized resell partner or distributor are eligible to participate in Xcelerate program (each an “Eligible Participant”). If you are unsure whether you are an Eligible Participant, please ask your AMD sales representative.

    Program Details and Open Period

  1. Xcelerate program is available from 1st Oct to 27 December 2024. AMD reserves the right to modify, suspend or terminate Xcelerate program at any time with or without notice.
  2. Only certain AMD products are eligible to clock points under Xcelerate program. AMD reserves the right to modify its product list and earning categories at any time during the promotion period. The eligible earning categories are available on the How to Win page on the Xcelerate program website which can be found here.
  3. AMD Xcelerate program accounts are non-transferrable and cannot roll over between individual participants and qualified AMD partners. If a Registered Participant leaves the employment of a AMD partner (whether voluntarily or involuntarily), and loses access to the Partner portal, their Xcelerate program access will also be suspended and they won’t be able to redeem any accrued points. Any unused points will be forfeited.
  4. The discovery of any falsification of any information submitted under Xcelerate program or any other attempts to undermine or otherwise defraud Xcelerate program, AMD, the program administrator, the program website or any other aspect of the program will result in immediate termination of the Registered Participant from the program. ANY ATTEMPT BY REGISTERED PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, AMD RESERVES THE RIGHT TO SEEK DAMAGES AND CRIMINAL SANCTIONS AGAINST SUCH REGISTERED PARTICIPANTTO THE FULLEST EXTENT PERMITTED BY LAW.

    Program Reward & Claims

  1. To qualify for the said Quarter Server Xcelerate Top Prizes, participating partners must submit at least one approved deal registration or deal closure in that corresponding quarter.
    • i.e. Participating Partners will be disqualified if they rank the Top 5 but did not submit any deal reg/closure
  2. Rewards are classified into 2 types:
    • - Experience
    • - Tangible Award

    For Experience that occur on specific day:

  1. Registered Participants are would need to participate in the experience day with the stated date.
  2. Should participant missed the experience day, they would have deem that they forfeited the event/prize as the Program Manager would not be able to replicate another event on another day.

    In event that the experience could not be executed/started due to weather, cancellation, we will organise the event at another day.

    For Prize Award and Collection

  1. AMD Event Organiser will hold the item for up to 90 days. Participants who won the award must collect their prize in person or accept the prize for their delivery.
  2. Registered Participants are responsible for paying all applicable federal, state, provincial or local taxes that may be due as a result of their participation in Xcelerate program.

    Data Handling

  1. AMD’s storage and use of any personal information Registered Participants submit to the Xcelerate program website will be subject to, and managed in accordance with, the AMD Privacy Policy.
  2. AMD may modify or update these Official Rules at any time with or without notice by posting any modified or updated Official Rules within the Xcelerate program website. The program, and the format, elements, rules, duration and / or Terms & Conditions of Xcelerate program may be modified, amended and / or discontinued at any time with or without notice.
  3. Neither AMD nor its administrator(s) assumes any responsibility for lost, late, damaged, incomplete, stolen, misdirected, illegible, unreadable or returned entries or for any computer, telephone, cable, satellite, network, electronic or internet, hardware or software malfunctions or failures, garbled, corrupt or jumbled transmissions, or service provider / internet / website accessibility or availability, traffic congestion, technical failures or unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information or the failure to capture such information.
  4. IN NO EVENT WILL AMD BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ANY PERSON’S PARTICIPATION IN THE PROGRAM OR ANY CONSIDERATION RECEIVED OR NOT RECEIVED IN CONNECTION HEREWITH. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE XCELERATE PROGRAM WEBSITE AND IN ANY VERSION OF THE AWARD CATALOG.

    IS PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. THE LIMITATIONS AND EXCLUSIONS OF LIABILITY ABOVE SHALL APPLY IRRESPECTIVE OF THE THEORY OF LIABILITY, INCLUDING CONTRACT (INCLUDING FUNDAMENTAL BREACH), WARRANTY, PRODUCT LIABILITY, STRICT LIABILITY, TORT (INCLUDING NEGLIGENCE) OR OTHER THEORY, EVEN IF AMD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
  5. AMD Xcelerate program is governed by Singapore law and is subject to all local laws and regulations. All disputes arising in any way out of this Program will be heard exclusively in, and the parties irrevocably consent to jurisdiction and venue, in the commercial courts of Zurich. AMD Xcelerate program is void where prohibited by federal, state or local law.
  6. In the case of account discrepancies, representatives must contact the AMD Xcelerate program Rewards Program team at support@amdserverxcelerate.com within three (3) months of the transaction date. Account discrepancies will not be investigated after this time period and may result in the loss of rewards. Partner representatives may be asked to supply written documentation of transactions in question. In the case of any dispute regarding reward points or any other aspect of the AMD Xcelerate program, AMD will make the final decision.
  7. AMD reserves the right to terminate your participation in the Program without notice, due to lack of participation for twelve (12) consecutive months, misrepresentation, improper or fraudulent use, noncompliance with the Program rules or any other aspect of the Program, abuse of the Program privileges, upon termination of employment, or at the request of the Program sponsor.
